Police: Naked intruder chokes dog, gets shot

A naked intruder who was trying to choke a pet Rottweiler was shot by a homeowner in Miami Wednesday morning, police said.

The bizarre incident happened around 5 a.m. when the occupants of the home were awoken when they heard a commotion and dogs barking.

When the homeowner went to check out the noise, he confronted the suspect, who was completely naked and trying to choke one of the dogs, police said.

"He comes out and spots a person who is not only fighting with this dog but is naked fighting with this dog," Miami Police spokesman Det. Willie Moreno said.

The homeowner opened fire twice, hitting the suspect in the leg once. The homeowner held the man until the police arrived.

The intruder was taken to Jackson Memorial Hospital where his condition was unknown. Police said he tried to bite the homeowners and police and workers at the hospital, and may be under the influence of drugs.

"For right now it does appear to be a justified shooting," Moreno said. "This individual was acting irrational, fighting with the dog, and not only that, but at the point that the homeowner attempted to get this individual's attention, he immediately jumped onto the owner and started fighting with him."

Police said the suspect, who refused to give his identity, will be charged with burglary of an occupied dwelling with assault, animal cruelty, resisting arrest with violence and lewd and lascivious behavior.

Mandeville mental health hospital now under private management ...

With the start of the new year, the hospital that for six decades made Mandeville synonymous with psychiatric care will have a new name and management structure. Under an agreement signed in early December, a Florida company on Wednesday formally assumed control of Southeast Louisiana Hospital near Mandeville, which will now operate under the name Northlake Behavioral Health System.

The changeover marks a major milestone in the facility's contentious conversion from a state-run mental health care hospital to a privately-managed property with oversight from the state Department of Health and Hospitals. Under last month's agreement, the DHH gave St. Tammany Parish authority to manage all property at the Southeast campus just east of Mandeville and signed a separate agreement to allow Meridian Behavioral Healthcare of Fort Lauderdale to operate 58 psychiatric inpatient beds: 42 for youths and 16 for adults. Another agreement between the parish and Meridian allows the health care company to operate the 58 beds on the Southeast campus.

The three-year agreement allows DHH to closely monitor operations at the hospital. The undertaking is the first of its kind for Meridian, which has been in business for about one year, officials said.

Meridian has announced the appointments of three executives to run the mental health facility, including Richard Kramer as chief operating officer. Kramer has been

CEO of Southeast Louisiana Hospital since 2010 and has more than 15 years experience in behavioral health hospital administration, according to Meridan's website. Over the past year, Kramer has also served as DHH's Director of Hospital Services under the Office of Behavioral Health.

Georgia Johnson has been appointed Northlake's Director of Nursing, and Sharon Taylor as the Director of Human Resources. Johnson, who has been director of nursing at SELH for the past five years, will be joining Northlake and Meridian with over 40 years experience in behavioral health nursing. She is a Clinical Nurse Specialist and is the current President of the Northshore Nurses Association. Taylor has more than 25 years of executive level experience in Human Resources in the public and private sectors. She has been a Director of Human Resources with DHH since 2005.

In a press release, Meridian CEO Wesley E. Mason said he is pleased with the new management team. "Each of these highly regarded professionals has been with DHH for a significant portion of their careers, and their acute understanding of the current SELH hospital operations, as well as the clients served here, will be invaluable to ensuring a smooth transition of the hospital to Meridian's management."

Meridian officials said the company met with more than 300 of SELH's employees who expressed interest in employment opportunities at the new privately-operated Northlake. Meridian anticipated that over 90 percent of the Northlake workforce will be comprised of individuals who are current SELH hospital employees and that full time employment offers will be made to around 150 individuals. In its heyday, SELH employed some 500 people.

But as the facility morphs into a private business, an organization formed to keep the hospital under the auspices of the state plans to continue its fight this weekend. The Committee to Save Southeast Louisiana Hospital will hold a public hearing at 3 p.m. Saturday at Mandeville City Hall. The committee is calling on the state and St. Tammany Parish to release documents related to the privitazation of SELH.

The group is also calling on the state to provide unspecified compensation to all SELH employees, who have "undergone painful psychological and material stresses" over the past six months, according to a news release from the committee.

Facing reductions in federal money for Medicaid, DHH announced in July that it would close SELH, a move they said would save $1.6 million this fiscal year and $3.5 million in subsequent years. The state health department has said it wants to ensure a sustainable behavioral care system for the future by de-emphasizing the role of large public institutions and instead building partnerships with community providers.

The announcement prompted a strong backlash from local officials, hospital staff members and patients' families. The immediate formation of the committee helped stoke the issue, with the group holding public rallies at the hospital and at offices of elected officials. Local legislators, many of whom are close allies of Gov. Bobby Jindal, began a push for privatization as a way of saving the services and jobs provided by the hospital. Hospital supporters, meanwhile, said they favored keeping the hospital in public hands and viewed privatization as a less desirable alternative. They feared private companies might be more concerned with profits than with the needs of the patients.

NATIONAL ASSOCIATION OF REALTORS ? Tax rates would remain the same for most households and mortgage cancellation relief is extended in a budget package passed by the U.S. Senate early this morning to avert the so-called fiscal cliff.

The House today could take up the bill, which NAR has been monitoring closely because the fiscal cliff?s automatic tax increases and federal spending cuts involve programs important to real estate and impact household wealth. Based on what the House does, the provisions in the Senate bill could change in the final bill.

(Editors Note: U.S. House of Representatives leaders initially voiced disapproval of the Senate?s bill because, they say, it doesn?t have enough spending cuts. Chances are, the House will amend the bill and send it back to the Senate or vote it down, forcing legislators to start over again, after pushing the nation over the fiscal cliff.)

The ?American Taxpayer Relief Act of 2012?? passed on a bipartisan 89-9 vote in the middle of the night and extends current tax rates for all households earning less than $450,000, and $400,000 for individual filers. For households earning above these limits, tax rates would revert to where they were in 2003, when taxes were reduced across the board. That means taxpayers in the highest bracket would pay taxes on ordinary income at a rate of 39.6 percent, up from 35 percent.

The tax rate on capital gains would also remain the same, at 15 percent, for most households, but for those earning above the $400,000-$450,000 threshold, the rate would rise to 20 percent.

Importantly from NAR?s perspective, the exclusion from taxes for gains on the sale of a principal residence of up to $500,000 ($250,000 for individuals) remains in effect, so only home sellers whose income is $450,000 or above and the gain on the sale of their house is above $500,000 would pay taxes on the excess capital gains at the higher rate (with corresponding numbers for individual filers). For the vast majority of home sellers, there is no change.

The bill also reinstates provisions that phase out personal exemptions and deductions for incomes over $250,000 for singles and $300,000 for couples.

A number of what lawmakers call extenders are in the bill. Extenders keep in place expiring tax provisions. Of most interest to real estate, the bill would extend mortgage cancellation relief for home owners or sellers who have a portion of their mortgage debt forgiven by their lender, typically in a short sale or foreclosure sale for sellers and in a modification for owners. Without the extension, any debt forgiven would be taxable, which, for underwater households, represents a financial burden.

Along with an extension for the Mortgage Debt Relief Act are extensions for deductions for mortgage insurance premiums and for state and local property taxes, which, along with the mortgage interest deduction, are important tax considerations for home owners and buyers.

In two other important provisions, the alternative minimum tax (AMT) is permanently adjusted for inflation, making it unnecessary for Congress to adjust it each year. The AMT was enacted in 1969 to help ensure a minimum tax bill for high-income households that would otherwise minimize their taxes by shielding much of their income in deductions and using other tax strategies. Because it was never indexed to inflation, AMT threatens to catch middle-income households in the tax, so Congress each year adjusts it. Now the adjustment would be permanent.

The other key provision is a change in the estate tax so that estates would be taxed at a top rate of 40 percent, with the first $5 million in value exempted for individual estates and $10 million for family estates. Currently, the top rate is 35 percent.

The other side of the fiscal cliff is hundreds of billions of dollars in automatic, across-the-board federal spending cuts, with a disproportionate share of the cuts affecting defense spending. The Senate bill would push back the deadline for the cuts for two months.

Twin mothers in Ohio give birth the same day

(AP) ? Aiden and Donavyn didn't wait until New Year's Day to come screaming into the world, but the circumstances of their births are still pretty special: The babies were born about two hours apart to Ohio mothers who are identical twins.

The Akron Beacon Journal (http://bit.ly/YQpn3X ) reports that the 19-year-old mothers ? Aimee and Ashlee Nelson weren't raised to do things alike and did not plan the births to come at the same time. In fact, their due dates were about a week apart.

But Donavyn Scott Bratten was born just after noon on the last day of 2012. Aiden Lee Alan Dilts made his appearance at about 2 p.m.

They were delivered by the same doctor at Summa Akron City Hospital.

Oil price jumps as US averts 'fiscal cliff'

The price of oil jumped by over a dollar on Wednesday, to above $93 a barrel, after U.S. lawmakers passed legislation to avoid a "fiscal cliff" that could have pushed the world's biggest economy into recession.

The U.S. House of Representatives voted near midnight to send the bill to President Barack Obama after a frantic day of political brinksmanship in Washington.

By early afternoon in Europe, benchmark crude for February delivery was up $1.49 to $93.31 a barrel in electronic trading on the New York Mercantile Exchange. The contract rose $1.02 to finish at $91.82 per barrel in New York on Monday.

Economists had warned that if Congress did not take action a series of tax increases and spending cuts due to automatically start this year could have helped push the U.S. into recession. They feared a spike in unemployment, which would have resulted in depressed demand for energy.

Some House Republicans at first opposed the bill, which neutralizes middle class tax increases and $24 billion in spending cuts set to take effect over the next two months while raising taxes on the wealthy. They wanted more spending cuts but hours later agreed to a simple yes-or-no vote on the bill, which had already passed the Senate.

As a result of a broad increase in market sentiment, the dollar weakened as investors felt confident to invest in relatively riskier assets. A weaker dollar makes crude cheaper and a more attractive investment for traders using other currencies. On Wednesday, the euro rose to $1.3280 from $1.3213 on Monday, the previous trading session.

Brent crude, used to price various kinds of international oil, was up $1.12 to $112.23 a barrel on the ICE Futures exchange.

In other energy futures trading on the New York Mercantile Exchange:

? Wholesale gasoline rose 3.88 cents to $2.8005 a gallon.

? Heating oil added 2.62 cents to $3.058 a gallon.

? Natural gas fell 4.1 cents to $3.31 per 1,000 cubic feet.
