There are many reasons why people decide to upgrade their home and there are many ways you can go about doing so too. Some people will have extensions put on their homes and others will simply remodel already existing rooms, but whatever they decide to do they should always seek out the services of a professional remodeling contractor to do the job. Let?s face it we aren?t all trained in the area of home improvements as we won?t all have the necessary skills, mindset or knowledge on how to do the job effectively or even right. It?s a much better idea to find the right Home Construction Michigan service to the home improvement tasks for you so that there?s no room left for error. The only issue that makes the task of finding the most professional and hard working home improvement contractor is the amount of companies that are out there to choose from. However with so many companies out there to choose from you get great opportunity to choose the best company for great prices.

There are a few things that will allow you to make up your mind on if a home improvement contractor is good enough to use. One is that the right home improvement firm will have years experience and even qualifications under their name, two is the necessary insurance certificates stating that they are covered by liability coverage and last but not least a huge list of satisfied clients under their belts. When you find a home improvements firm that has this amount of professionalism behind them you know that you can?t go wrong. So if you look for companies using these preferences you will seriously narrow down your search to only the finest home remodeling services in Michigan. The last thing you will need to filter through is prices and once you?ve done that, you will find that you have the best home construction contractor Michigan working on your home for the lowest price possible. There will be cheaper firms out there but they won?t have the level of expertise necessary to do the high quality job that your new found construction contractor will have.

One of the most reputable home construction Michigan services that have been reported to bring in amazing results is Jason Foldenauer Construction, LLC. Jason Foldenauer Construction, LLC have been remodeling Michigan?s homes one by one over the years and they are proud and satisfied with their high standard service. Tomlin a 'win-at-all-costs' guy

120526-football.nbcsports-story-612AP

Sunday?s sports pages from sea to shining sea not only included an Associated Press column regarding gambling on NFL games, but also contained an AP article on the future of youth football.? The item from Chris Jenkins provides an accurate snapshot of the practical consequences flowing from the combination of a generation of helicopter parenting and the advancement of medical knowledge regarding the long-term effects of mild brain trauma.

With or without the concussion lawsuits and the suicides of Dave Duerson and Junior Seau, mothers and fathers would continue to shy away from exposing young children to the more immediate risks of playing football.? If padded youth tackle football will survive over the long term (and, frankly, for kids under the age of 12 I?m not sure that it should), efforts must be made to ensure that coaches will be more responsible.

Plenty of the men who give their time to the coaching of youth football undoubtedly have good intentions and use appropriate methods, placing the well-being of their players over the ?win-at-all-costs? mentality that infects coaches at every stage of the sport.? But some coaches make youth football their own personal NFL, allowing an obsession with victory to cloud common sense and, at times, basic decency.

Forty years ago, youth coaches routinely denied their players water during practice, kicked them in the asses when they were loafing (I still have a cleat mark or two in mine), and corrected alignment errors by pulling them by the facemasks into the right position.? Though the days of football coaches laying hands on kids have long since ended (except for Mike Vanderjagt . . . allegedly), plenty of youth coaches still insist on a ruthless, aggressive approach from boys who should still be boys, in every way.

I?ve witnessed it.? Several years ago, Florio Jr. had soccer practice.? Nearby, a youth football team was padded up.? The coach was barking at kids no older than 10 like they were adults, cajoling them to be ?mean? and ?nasty? and to hit the other team so hard that when they cross paths at the mall during high school the opponents will still feel intimidated by it.

It?s shameful and it?s irresponsible and it needs to end, or youth tackle football eventually will.

And that?s where the NFL?s assumption that changes made at the top of the sport will trickle down could be erroneous.? Pro football coaches are accountable to the league office.? College football coaches answer to the NCAA.? At the high-school level and below, who?s really paying attention to what these coaches say and do?

That?s why it?s critical for efforts like the Lystedt Law to be successful in every state.? Without external bright-line rules regarding concussions, coaches who are largely left to their own devices will continue to be able to do things the way they?ve always been done, regardless of any advancements that are made to protect the grown men who play the game.

At every level below college, the challenge for football will be to adapt to the new expectations of society and parents and players, or to face the fact that players and parents and ultimately society will choose another path.? Though it won?t kill the sport completely, it will make it harder for colleges and NFL teams to identify and develop the best of the best available players.

Thus, every college team and every NFL franchise has a direct interest in finding ways to ensure that the stewards of the youth and high-school versions of the game behave responsibly, prudently, and properly when it comes to ensuring the health and safety of the boys and young men entrusted to them.

Wildfires force evacuations in New Mexico, along Colorado-Utah border

This photo provided by the Michigan Department of Natural Resources shows a wildfire in Michigan's Upper Peninsula. The fire grew by 17 percent to more than 21,000 acres Saturday as officials warned of tough conditions and welcomed help from water-dumping aircraft from the Michigan National Guard. (Michigan Department of Natural Resources)

ALBUQUERQUE???Residents near a privately owned New Mexico ghost town were ordered Saturday to evacuate as a blaze in the Gila National Forest continued to burn erratically, as Colorado crews took to fighting a new fire along the Utah-Colorado border.

Fire officials in New Mexico said Saturday that the Whitewater-Baldy Complex fire has shrunk slightly to 82,000 acres but is still zero percent contained because of weather conditions.

The evacuation of Mogollon, a privately owned ghost town, was ordered due to extreme wind around the southwestern New Mexico fire. Four helicopters and more than 500 firefighters from across the state were on hand to fight the blaze but still had to contend with "extreme conditions."

Cities as far away as Albuquerque remained under a health alert until this afternoon due to smoke from the fire, which has spread across the state. Officials were warning residents to limit outdoor activities.

Meanwhile on Saturday, crews in Colorado battled a wildfire that has scorched at least 3,000 acres of rugged canyon land near the Colorado-Utah border. U.S. Forest Service spokesman Steve Segin said the fire started Friday afternoon and is burning in a remote area near Paradox. It is not threatening any structures, and no injuries have been reported.

Shannon Borders, a spokeswoman for The Bureau of Land Management, said sheriff's deputies have evacuated the Buckeye Reservoir area, a popular recreation spot near the Utah border. The Rock Creek and Sinbad Valley areas also were evacuated.

In California, higher humidity and light winds were helping firefighters get ahead of a wildfire that has charred 4,100 acres of tinder-dry grass and brush in rural San Diego County.

A wildfire in Michigan's Upper Peninsula grew by 17 percent to more than 21,000 acres Saturday as officials warned of tough conditions and welcomed help from water-dumping aircraft from the Michigan National Guard. The fire, known as the Duck Lake fire, was 20 percent contained.

Smoke from n.m. wafts into colo.

Police dispatchers and other authorities along the Front Range and in other parts of Colorado reported receiving calls from residents concerned by the smell of smoke and the haze in the air. Officials said it was due to strong winds kicking up smoke from a massive wildfire that has torched 82,000 acres in southwestern New Mexico. Although much of Colorado is under a "red flag" warning ? meaning that low humidity and high winds create conditions ripe for a fire ? there were no sizable fires in the state as of Saturday afternoon. November 19th, 2011 // 11:32 am @ matt

One of my most recent tasks at Food on the Table was to implement speech recognition for our meal planning app?s grocery list on Android. Now that the first version of the feature is released, the fully featured product allows users to quickly add items just by speaking into their phone. Not only that, but the app knows to separate items whenever you say ?and? in between (e.g. ?bacon and eggs and cheese? get added as separate items to your list as ?bacon?, ?eggs?, and ?cheese?), determines which department the item should be categorized into, and automatically appends sale data based upon whether or not the item is on sale where you shop.

Most of the backend for this was already implemented from our company working on other tasks. The newest piece to get this working was the voice recognition itself. Fortunately, Android 2.1+ comes with speech recognition capabilities via the RecognizerIntent.

The basic logic is as follows:

  1. Create an Intent that calls the speech recognizer action,
  2. Pass various parameters, such as the user prompt string and max number of desired results,
  3. Accept the response in the form of an array of strings, where the first array item is most likely to correctly match what the user said.

Because we?re using Appcelerator Titanium for our mobile development, this means all our code is built using JavaScript with wrappers and proxies that act as interfaces to the raw Java Android code. This also means that some of the work is simplified, such as a callback method being directly passed to an intent that returns a result, as opposed to defining a special method that handles all results as is typically done on Android.

Unfortunately, at times it becomes clear that working with Titanium is going to take a bit of extra work compared to coding natively for Android.

As I mentioned above, when Android?s speech recognition Intent is successful, it returns an array of text strings that are most likely to match what the user said. To access this array of strings, there is a method on the Intent class named getStringArrayListExtra. The problem is that Titanium?s IntentProxy does not provide a wrapper for this method. As such, the temporary solution until it is included in Titanium Mobile core is to create a custom module that acts as a middleman between the JavaScript and Android layers.

Implementing this took some time, as it was my first time working with Titanium modules, but it turned out to be relatively simple. Since extending Titanium?s core implementation of IntentProxy into a subclass won?t work, I had to essentially create a helper class that accepts the IntentProxy and the parameters required for the method, calling the actual method on the Intent given those parameters.

@Kroll.method public String[] getStringArrayListExtra(final IntentProxy intentProxy, final String name) { 	if (DBG) { 		Log.d(LCAT, "getStringArrayListExtra called with name:" + name); 	} ? 	final ArrayList<String> list = intentProxy.getIntent().getStringArrayListExtra(name); 	return list != null ? list.toArray(new String[list.size()]) : null; }

Let?s break down what?s happening here. First, the @Kroll.method is a simple annotation used by Titanium to say ?this method should be available when accessed through the JavaScript.? If the annotation weren?t included, then the method would only be accessible by other Java classes.

Next, the DGB and Log.d lines simply create an entry in the Android log for debugging purposes. This doesn?t effect the outcome of the function at all, and is simply useful for anyone attempting to debug their code. Removing these lines would have no effect on the actual implementation of the core functionality.

On the next line, where I define list, I first get the actual Android Intent object from the IntentProxy. Once I have the Intent object, I can call the method I?ve been trying to reach in the first place ? getStringArrayListExtra ? passing the name parameter provided to the proxy. This method returns an ArrayList of String objects.

Finally, we want to turn a simple array of String objects from our new method. The reason I chose a string array is that Titanium already has the built-in logic to convert a Java array into an array object that JavaScript understands. To return a string array, we need to convert the ArrayList into an array. Fortunately, this can easily be done by calling the toArray method on the ArrayList object that we already have. (If the object is null, then we simply return that instead.)

Great! So now it?s time to compile, implement, and test out our module. Throwing a little speech recognition code together, it quickly becomes clear that there?s another problem. As it turns out, Titanium does not properly handle putExtra for integer values. As such, we?ll need to add a new method called putIntExtra to our custom Intent module to perform this task.

@Kroll.method public void putIntExtra(final IntentProxy intentProxy, final String key, final Object value) { 	if (DBG) { 		Log.d(LCAT, "putIntExtra called with key:" + key + "\", value:" + value); 	} ? 	if (value instanceof Integer) { 		intentProxy.getIntent().putExtra(key, (Integer) value); 	} else { 		intentProxy.getIntent().putExtra(key, (int) Double.parseDouble(value.toString())); 	} }

Breaking this down, you can see that it behaves similar in structure to the original module method I described. First, we accept the IntentProxy object along with the desired key and value for the extra data. Note that we accept the value as an Object though since JavaScript uses loose variable types.

Next, we provide the same basic debug logging as mentioned before.

Now we get to the actual heart of what?s happening. Even though I don?t do so myself, this code can technically be called from the Java itself. As such, I perform a preliminary check to see if the value is already an Integer instance. If so, then we don?t perform any magic, and simply call putExtra on the intent. (Java?s automatic unboxing handles the Integer to int conversion.) However, if the object is not already an Integer, then we need to convert it to one.

At first, I tried to utilize the Integer.parseInt method to convert the string representation of the object. However, it turns out that the object was being passed in as ?1.0?, and the decimal point was causing an exception to be thrown when this method was called. As such, the solution was to parse the string as a Double, then case that to an integer. This simply removes anything after the decimal, meaning that a value of 1.9999 would become 1. I decided this is acceptable since the method is intended to only be receiving integer representations in the first place.

Finally, after recompiling, reimplementing, and retesting the code, we find that speech recognition now works. The Titanium JavaScript code is returned an array of strings when our RecognizerIntent finishes successfully, and we can use this string to populate our grocery list items for the user.

Here?s an example of the Titanium code used to perform the speech recognition through our new module.

var intentModule = require("com.foodonthetable.intent"); ? var intent = Ti.Android.createIntent({   action: "android.speech.action.RECOGNIZE_SPEECH" }); ? intent.putExtra("calling_package", "com.foodonthetable.mobile"); intent.putExtra("android.speech.extra.PROMPT", "Start speaking..."); intent.putExtra("android.speech.extra.LANGUAGE_MODEL", "free_form"); intentModule.putIntExtra(intent, "android.speech.extra.MAX_RESULTS", 5); ? // For retrieving the array list  Ti.Android.currentActivity.startActivityForResult(intent, function(event) {   if (event.resultCode == Ti.Android.RESULT_OK) {     var intent = event.intent;     var results = intentModule.getStringArrayListExtra(intent, "android.speech.extra.RESULTS"); ?     if (results && results.length) {       console.log("There were " + results.length + " results");       for (var i in results) {         console.log("Result " + i + " = " + results[i]);       }     } else {       console.log("No results");     }   } });

Feel free to view or modify the full source code on Github. If you have any suggestions for improvement or actual code changes, feel free to contact me or fork my code and submit a pull request. Also, check out the Android meal planning app that?s using this feature for a full demonstration.

Brian Johnson, Mike Zunino lead Florida past South Carolina in SEC Tournament

HOOVER, Ala. |?Brian Johnson pitched a five-hitter, and Mike Zunino hit a two-run homer to lead Florida to a 7-2 win over South Carolina on Friday night, eliminating the two-time defending national champions from the Southeastern Conference Tournament.

The Gators (42-17) face Vanderbilt today for a shot at the SEC championship. The Gamecocks (40-17) went 1-2 at Regions Park.

Johnson (7-4) pitched his first career complete game and had retired nine in a row before giving up back-to-back hits and a run in the ninth.

"He didn't misfire all night," Florida coach Kevin O'Sullivan said. "He executed his pitches all night long, and that's really what you have to do against a team like South Carolina."

Johnson struck out five, didn't walk anybody and coasted through on 89 pitches. And he finished, despite the ninth-inning run.

"I felt good," said Johnson, who also had an RBI on a bases-loaded walk in the fifth. "I came in in the eighth and told Sully I wanted to finish it."

His last trip to Hoover didn't end as well. He sustained a concussion after getting struck in the back of the head by a ball in last season's tournament.

The Gamecocks only managed one other threat off Johnson before the final inning. They had back-to-back singles to open the sixth, but Johnson got Joey Pankake to ground into a run-scoring double play.

Casey Turgeon added a two-run single in the three-run fifth to make it 7-0.

Zunino had an RBI groundout in the first and then delivered his league-leading 16th home run with a shot over the left-field fence in the third for a 4-0 lead.

"We wanted to come out early and often, and that's what we talked about right before the game," said Nolan Fontana, who went 2 for 3 with a pair of walks and three runs scored for the Gators.

Turgeon, Preston Tucker and Josh Tobias also had two hits for the Gators.
Chase Vergason went 2 for 3 for South Carolina.

The Gamecocks had beaten Florida twice in the College World Series to claim the national title last season, but they were outhit 11-5.

Starter Colby Holmes (6-1) couldn't make it out of the third in his first loss of the season.

"We've had a lot of games this year where our pitching has carried us," South Carolina coach Ray Tanner said. "We weren't very good tonight, and you can't do that against a team like Florida when Brian Johnson's on the mound.?He's very good. He's going to pitch on the next level and probably for a long, long time."

With 42.5% of all Atlanta home sales in the 1st qtr of ?12 distressed, the impact of distressed homes on the greater Atlanta housing market is a significant one. They are present in force and their impact influences every aspect of the Atlanta real estate market, they are expected to be around for the foreseeable future.

The metro Atlanta real estate market appears to have bottomed in Jan ?10.

The charts below illustrate just how significant an impact distressed homes have on Atlanta real estate market conditions. While Atlanta is too large an area to be considered as one, the charts below (courtesy of Chartmasters) illustrate that while some areas are climbing out of the mud, others remain deeply mired.

A few key points:

  • Statistics show that the Atlanta real estate market bottomed out in January 2010. To some extent it has been a prolonged bottom from ?08 on
  • 42.5% of homes sales in Atlanta were distressed in 1st qtr 2012
  • Over the last year, distressed home sales in Atlanta ranged between 38.9% and 42.5% of all sales
  • 57.9% of sales under 100K, 41.8% of sales between 100K-200K and 20% of sales over 1M were distressed in the 1st qtr 2012
  • It is a seller?s market for distressed properties in Atlanta across all price points with a very low overall ??months of supply? of 2.7
  • It is a buyer?s market for non-distressed properties in Atlanta above 100K with an 8.1 ?months of supply? volume. Under 100K is a seller?s market for non-distressed homes
  • The Dunwoody area had the lowest percentage of distressed property sales for 1st qtr 2012 at 8.1%
  • Eastern Gwinnett County had the highest percentage of distressed property sales for 1st qtr 2012 at 66.1%

The charts below reflect the stats from the Atlanta real estate market for the 1st quarter of 2012. Divorce Attorney Montgomery County - Personal Injury Law - Fox ...

Last updated 2 hours 11 minutes ago

Accidents happen all the time?however, if you suffer a personal injury due to downright carelessness of a third party, then you may be entitled to compensation and have the right to file a claim. If you want to file a claim, contact a?personal injury lawyer?to help you through the process. This article will explore the concept of?negligence?and the role it plays in personal injury law.?

  • What is negligence in a legal context??
Negligence is from the Latin word?neglegere,?which literally means ?not to pick up.? Negligence doesn?t refer to intentional or specific harm, but rather carelessness that leads to a person getting hurt or even dying. For example, if a business allows clearly unsafe conditions to exist on its property, then that business is negligent and is responsible for any injuries incurred.???
    ?
  • When is negligence applicable?
If a surgeon operates on the wrong?part of the body, then he is being negligent. Negligence is not applicable, however, if a surgeon performs a patient-approved, high-risk surgery that fails. Negligence is only a factor when there has been an error that could have been easily avoided. This applies to car accidents, dog bites, slip and fall injuries, and nearly any other time someone exercises carelessness.
    ?
  • What should you do if someone is negligent??
If you or a loved one has become the victim of someone?s negligence, you may be able to file a personal injury claim. You should hire a personal injury lawyer immediately to lay out your case and present the guilty party with proof of carelessness. Most of the time, the guilty party will see that you have a good case and will?settle out of court. If not, then the case will go to trial and be settled by a judge or jury.

If your life is no longer the same because of someone?s careless mistake, then you may be entitled to compensation. Contact Fox and Fox Attorneys at Law?our?Montgomery County?personal injury lawyers?will be happy to review your case and recommend the next course of action. Richard (RJ) Eskow: How to Fix the Fed: Dismiss Dimon, Boot the Bankers, and Can the Corporations

More and more people are calling for Jamie Dimon, CEO of troubled JPMorgan Chase, to resign from the Board of the New York Federal Reserve.

His latest scandal, combined with Dimon's hypocrisy and relentless self-promotion, make him an obvious target. But he isn't alone. Bankers dominate the Fed at the regional and national levels, and most of the other outside seats are held by executives from large corporations. (Remember Herman Cain?)

Should Dimon resign? They all should.

The Board Member With No Name

The scary thing is, Dimon may not be the Fed's most inappropriate board member. That honor may belong to the individual I call the Board Member With No Name.(I don't to want inflame emotions by identifying her, because what she represents is more important than who she is.)

Shouldn't a r?sum? that includes being the top bank lobbyist and working for the firm that laundered a third of a billion dollars for Mexican drug cartels disqualify someone from serving at the Fed?

Before she became the banking industry's chief lobbyist, the Board Member With No Name's was an executive at scandal-plagued Wachovia Bank, an institution whose egregious mismanagement led to its collapse and a government rescue. Its scandals and crimes included: deceptively packaging its toxic subprime mortgage backed securities; rigging municipal bond bids, which led to a $148 million fine ; and, worst of all, laundering $378 billion in drug money for the Mexican cartels that have murdered at least 60,000 people.

The legislators who passed the Federal Reserve Act of 1913 couldn't have imagined that someday one of its governors would come from a firm that was buste,d when its laundered money was used to buy a drug-smuggling plane in Sinaloa.

Banks are large organizations, and it's highly unlikely that the Board Member even knew about the wrongdoing. She looks like a very nice person - and she probably is. But her background hardly qualifies her for a position of public trust. After all, she's only two or three degrees of Kevin Bacon away from cartel bosses like "El Loco," who leads a group of deserters from the Mexican Army's Special Forces known as "Los Zetas."

Coincidentally, El Loco was arrested this week for beheading 49 people and dumping their bodies in the town square.

The drug cartels have been called "vicious," "evil," and "sociopathic." At Wachovia they were also called "preferred clients."

Conflicted

The New York Fed is the most powerful of all the regions - understandably, since it includes Wall Street. Dimon's one of three bankers on its board. One of the others is from a bank which still owed the government nearly $1 billion in TARP money as of last report. The corporate world is represented by the CEOs of a technology venture capital firm, an HMO, and the company which owns Macy's and Bloomingdale's (who's actually said to be a good guy.)

The Richmond Fed's bank representatives include the leaders of First Citizens Bancshares and CommerceFirst bank, as well as the managing partner of a Charleston law firm who specializes in labor and employment law (judging from his resume he defends corporations). There are also executives from an oil company, a big construction company, and an aerospace manufacturer. The Seattle board includes executives from Wells Fargo Bank (Wachovia's new parent) and Boeing.

And so it goes ...

Other banks and corporations represented at the regional or branch level include Bank of America, Boyd Gaming, Shorenstein Properties, Dow Chemical, Nissan, AutoNation, USAA, IBM, Southwest, JC Penney, USG, Nissan, along with energy and lumber companies and some of the legal and accounting firms that serve the country's megabanks.

Of nearly 250 Board members for the Fed's regions and branches, I was able to identify only three union representatives (from the AFL-CIO), one or two pension fund representatives (pension funds have been robbed blind by the big banks), and one member of a housing coalition. The Fed's boards have become more exclusive than a country club - and a lot more powerful.

Federal Case

Why do we even have a Federal Reserve? There are people - mostly libertarians of the Ron Paul school - who think it should be abolished. They're wrong. We need a central bank. The financial crises which peppered our early history proved the need for a secure dollar backed by the "full faith and credit" of the United States government.

Panics like the one that led to William Jennings Bryan's famous "Cross of Gold" speech were led by speculators who became wealthy at the expense of working people and farmers. Back in the 19th Century many banks issued their own dollars, leaving both buyers and sellers unsure of their value from day to day. Anybody who had been holding "Lehman Brothers dollars" would be out of luck today.

So the question isn't whether we need a central bank: We do. The question is, Why is it dominated by the people who have already ruined the economy once - and who have a clear conflict of interest?

The World's Biggest ATM

Give a bunch of bankers access to the world's biggest ATM and look what happens: As Bloomberg News reported last August, "Wall Street's aristocracy got $1.2 trillion in secret loans" from the Federal Reserve.

What the Federal Reserve hasn't done is carry out its mission, which the Fed's own "Purposes and Functions" document describes as:

  • conducting the nation's monetary policy by influencing the monetary and credit conditions in the economy in pursuit of maximum employment, stable prices, and moderate long-term interest rates
  • supervising and regulating banking institutions to ensure the safety and soundness of the nation's banking and financial system and to protect the credit rights of consumers
  • maintaining the stability of the financial system and containing systemic risk that may arise in financial markets

  • providing financial services to depository institutions, the U.S. government, and foreign official institutions ...
When it comes to that last bullet point, the Fed's knocked it out of the park. They serve the banks quite well. The others? Not so much.

Scoring the Fed

Let's rate the Federal Reserve according to the parameters it set out for itself:

  • "Maximum employment": Thanks to the Fed, banks have had access to free or very-low-cost money, which they've used to make money on Treasuries and other safe investments. But they haven't been lending it to the consumers and small businesses who are the engines of job growth.
  • "Stable prices": Gas prices keep swinging up and down radically because of speculation.
  • "Moderate long-term interest rates": Yes - but is that good? Opinions vary.
  • "Safety and soundness of the nation's banking and financial system": JPMorgan Chase's recent debacle shows how little the Fed has accomplished here. but then, how easy can it be to rein in Jamie Dimon when he's chairing the meeting?
  • "Protect the credit rights of consumers": Massive mortgage fraud by major banks. One settlement after another for deceiving consumers. How much time do you have?
  • "Maintaining stability ... containing systemic risk": JPMorgan Chase's latest debacle settles this issue once and for all ...
... By any objective measurement, the Federal Reserve has failed to do meet these key objectives.

The Radical Fed

Is it any wonder that the Fed gave out more than a trillion dollars to Wall Street's biggest banks - and did it in secret? (That alone would appear to violate securities law, since it allowed bankers like Jamie Dimon to materially misrepresent the financial condition of their corporations.)

And that's not all the newly radicalized Fed has done. It broke the rules by allowing Goldman Sachs and GE Capital to call themselves "banks" - just in time to collect their taxpayer-funded bailouts. But it hasn't shown any flexibility when it comes to demanding that banks use some of their low-interest Fed loans to lend to the people and companies that will use it to create jobs.

The Fed has even broken its own rules in order to protect bad bankers. As Prof. Steven Davidoff noted in the New York Times: "In Blocking Activists, the Fed Protects Poorly Performing Banks." It's also protecting poorly performers bankers - like the ones that sit on its boards.

In one case the Fed blocked a shareholder action by invoking a rule which said an outside party couldn't have more than 25 percent control of a bank - but the shareholder would only have acquired 22 percent control. As Davidoff documents, Fed is repeatedly bending or violating its own rules to prevent shareholders from exercising their rights to limit executive compensation or take action against underperforming or ethically-challenged executives.

The Fed has changed the playbook for bankers over and over. But whenever someone suggests imaginative programs to stimulate the economy by helping consumers or small businesses the Fed suddenly decides it's a stickler for the rules.

Resistance Is Futile

In our interview for The Breakdown last week, Paul Krugman reiterated his statement that his former Princeton colleague Ben Bernanke has "joined the Borg." The "Borg" is the collective alien entity from Star Trek that takes over people's identities and leaves them with no other mission but expanding its own power. These Federal Reserve boards represent the Corporate Borg in all its unchecked power - but the power they possess is power that we have given them, through our elected representatives.

It doesn't have to be this way. There are good folks on the Committee, like Janet Yellen, Sarah Bloom Raskin and Daniel Tarullo.

But they're the exceptions, not the rule.

Enter Sanders

That's why Sen. Bernie Sanders' Federal Reserve Independence Act is so important. The bill would eliminate these conflicts of interest and force the Fed boards to stop serving bankers' interests and return to the Fed's original mission. People should insist that their Senators support it.

The bill follows on the Federal Reserve Transparency Act, which was cosponsored by Sen. Bernie Sanders and Rep. Ron Paul. That bill demanded a public audit of the Fed, which is how we learned about those massive secret loans. That act showed that the left and the right can work together to change our broken central banking system.

It's time for a replay of that coalition the elimination of these conflicts of interest, and a return to accountability for the Fed.

Dissing Dimon

Which gets us back to Jamie Dimon. When the prominent economist Simon Johnson first demanded Dimon's resignation he noted that, while his role is sometimes described as "advisory," Dimon sits on the Management and Budget Committee which supervises the pay of senior Fed executives.

That committee also approves the self-evaluation of senior Fed executives - which essentially means it gives them their performance reviews. It reviews and approves the Fed's overall budget, too, including the budget for auditing bankers like Jamie Dimon. According the Fed itself, its other main responsibility is to "review and endorse the Bank's strategic plan."

Budget, compensation, strategic planning: That pretty much covers everything.

Johnson's call for Dimon's resignation has been joined by Elizabeth Warren and the American Constitution Society for Law and Policy, which calls Dimon's position "a stunning conflict of interest."

They're right, of course. But in saner times people would also be demanding that Dimon resign from his bank, too. His tenure as CEO has been marked by a wave of massive deals to settle criminal and civil charges. That alone would have led to disgrace and resignation in more civilized times.

Even in today's more mercenary atmosphere, Dimon's nothing to write home about: The stock was worth around $40 when he became CEO in 2005 and never rose much above $50 after that. It was $33.78 after this latest fiasco.

Dismissing Dimon

From his perch on the New York Fed board, Dimon has had a front row seat to the dispensing of a trillion dollars in secret cash to Wall Street banks - including his own. His bank reportedly received as much as $48 billion in secret loans at 1.1 interest, when less privileged banks were paying 3.8 percent. The money saved in interest on that loan alone could amount to almost $1.3 billion.

It's like the old saying goes - a billion here, a billion there, and pretty soon you're talking about real money.

Dimon's always been a paper tiger, a product of his own PR campaign and the low standards of his profession. If he won't resign as JPM's CEO, he should certainly resign as its Board Chairman, a title he assumed in 2006. That's another clear conflict.

An ethically-managed Federal Reserve wouldn't wait for Dimon to resolve this internal conflict by giving up one of these roles. It would have demanded it long ago. And it would have dismissed Dimon from its Board for JPMorgan Chase's past scandals, as well as the one that just came to light.

And now for something completely different ...

It seems like something out of a Monty Python routine. The boards that govern the Federal Reserve, the publicly-created central bank that dispenses money to bankers, are all dominated by ... the bankers who receive that money. Picture it if you can:

Fed Board room, 2008:

ECONOMIST: This is serious! The global economy is collapsing because of your reckless gambling!
LONE CITIZEN BOARD MEMBER: That is serious. What can we do? We could break up our banks and fire their executives, or ...
BANKER: Wait! I've got it! Give us more money!
(Nods all around the table)

Six months later:

ECONOMIST: This is serious! We've given you money but you're not lending it out to get the economy moving!
LONE CITIZEN BOARD MEMBER: That is serious. What can we do? Perhaps there could be rules and conditions about lending that ...
BANKER: Or they could give us more money!
OTHER BANKERS: Good one! Let's go with that!

Three years later:

ECONOMIST: This is serious! Joblessness is still at record highs. Poverty has soard. Too-big-to-fail banks are bigger than ever. And you guys are still breaking the law and skirting the rules.
LONE CITIZEN BOARD MEMBER: Hmm. That is serious. The Fed could use its regulatory authority to ...
BANKER: (aside) I hate that guy. (to all) Let me see ... hmmm ... how about giving us more money?

Three and a half years later:

ECONOMIST: This is serious! The country -
BANKERS (in unison): More money!

Clean Up the Boards

The Federal Reserve's governing structure isn't quite that bad - but it's pretty close. As the President of the Kansas City Federal Reserve just noted, bankers have a "special obligation" to maintain the "integrity, dignity and reputation" of the central bank. ""No individual is more important than the institution and the public's trust," she added.

We'll go a step further: The public's trust can no longer be given to a central bank whose governing bodies are dominated by the wealthy and powerful. Bankers and large corporations should be asked to provide information to the Fed, and should be encouraged to offer their advice. But they don't belong on its boards or committees.

It's time to give those seats to people who will work on behalf of the citizenry which created the Federal Reserve in the first place.

Facebook shares stabilizing, but probes mount

NEW YORK (AP) ? Facebook's initial public offering is the subject of two congressional inquiries and mounting lawsuits as the social network enters its fifth day of public trading on Thursday.

The shares regained some ground Wednesday, climbing $1, or 3.2 percent, to close at $32. But that gave shareholders only minor relief.

The stock's rocky inaugural trading day Friday was followed by a two-day decline, and it's still trading nearly 16 percent below its $38 IPO price.

The launch was tarnished by a half-hour delay on Friday, caused by glitches on the Nasdaq Stock Market. It was marred further this week as investors began accusing the banks that arranged the IPO of sharing important information about Facebook's business prospects with some clients and not others.

Several shareholders who bought stock in the IPO have filed lawsuits against Facebook, its executives and Morgan Stanley, the IPO's lead underwriter. At question is whether analysts at the big underwriter investment banks cut their second-quarter and full-year forecasts for Facebook just before the IPO, and told only a handful of clients about it.

One lawsuit, filed in U.S. District Court in New York, claims Facebook's IPO documents contained untrue statements and omitted important facts, such as a "severe reduction in revenue growth" that Facebook was experiencing at the time of the offering. The suit's three plaintiffs, who bought Facebook stock on its first day of trading May 18, claim they were damaged in the process.

Morgan Stanley declined to comment. Facebook said the lawsuit is without merit.

Another lawsuit, filed in San Mateo County Superior Court in California, claims Facebook and underwriters misled investors in Facebook's IPO documents. Both lawsuits seek class action status on behalf of investors who bought Facebook stock and lost money on Friday.

"No one gets it perfect, as far as saying what the financial results are," said Anthony Michael Sabino, professor at St. John's University's Peter J. Tobin College of Business. The bottom line, he added, is whether Facebook or the underwriter had material information about Facebook's finances that was not disclosed publicly.

"At this moment, it's still too early to say," Sabino said. "We don't know enough, but this could turn out to be an issue."

What is known is that, in March, Facebook began meeting with analysts at the underwriting firms. The gatherings are a customary part of the IPO process and are designed to help analysts understand the company's business so they can make accurate financial projections.

On May 9, the third day of Facebook's pre-IPO roadshow to meet with prospective investors, the company filed an amended IPO document that said its number of mobile users was growing faster than its revenue.

According to a person familiar with the matter, Facebook then had another meeting with analysts and told them that based on the new information in the filings, the analysts' forecasts should be at the low end of the range that the company gave them in April. The person spoke on the condition of anonymity because they were not publicly authorized to discuss the matter.

Adding to Wednesday's events, Facebook was in talks with the New York Stock Exchange to move its stock from the Nasdaq Stock Market after the botched offering, according to a person familiar with the matter.

The person spoke on the condition of anonymity because they were not authorized to speak publicly. The news of the talks was first reported by Reuters.

NYSE spokesman Rich Adamonis said: "There have been no discussions with Facebook regarding switching their listing in light of the events of the last week, nor do we think a discussion along those lines would be appropriate at this time."

A Nasdaq spokesman declined to comment.

Sen. Tim Johnson, D-S.D., chairman of the Senate Banking Committee, said late Wednesday that his panel wants to learn more about the social network's initial offering. The committee seeks briefings with Facebook representatives, regulatory agencies and others.

After the briefings, Johnson said, he will determine whether a hearing should be held.

Also gathering information about Facebook's IPO is the House Financial Services Committee. An aide to that panel said its staff is getting briefings.

The subject is likely to be raised in hearings by the committee in the coming weeks, even though no hearings are planned specifically on the Facebook IPO, the aide said. The aide spoke on condition of anonymity because the House committee's planned inquiry hasn't been publicly announced.
